1. Scope
These General Terms and Conditions (AGB) apply to all orders placed via our online shop www.seamone.de and our Etsy shop by consumers within the meaning of § 13 BGB (German Civil Code).
A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their independent professional activity.

As we apply the small business scheme (Kleinunternehmerregelung) pursuant to § 19 UStG (German VAT Act),
we do not charge VAT and therefore do not show it.
3. Offer and conclusion of contract
The product presentations in the online shop do not constitute a legally binding offer, but an invitation to place an order. By completing the ordering process, you submit a binding offer to purchase the digital product.
The contract is concluded as soon as you receive an order confirmation by e-mail or the download is made available to you.
4. Delivery and access
There is no physical shipping.
Once payment has been received, you will get immediate access to the digital product via a download link by e-mail or in your customer account.
5. Prices and payment
All prices are final prices excluding VAT (where applicable). Payment is made by credit card, PayPal or the payment methods offered in the shop.
6. Copyright and rights of use
All digital content (e.g. sewing patterns, templates, e-books) is protected by copyright.
With your purchase, you receive a simple (non-exclusive), non-transferable right of use for private use.
Passing on, reproduction, publication or commercial use is prohibited without express permission.

7. Right of withdrawal
Consumers are generally entitled to a right of withdrawal of 14 days.
Exception: The right of withdrawal expires if the download of the digital product has begun and you have expressly consented to performance of the contract beginning before the end of the withdrawal period.

8. Warranty (liability for defects)
The statutory law on liability for defects applies. For digital products, there is no entitlement to physical functionality (e.g. printer problems, software compatibility), provided the download has been carried out properly.
9. Final provisions
The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
To the extent permitted by law, the place of jurisdiction is the provider’s registered place of business.
Should individual provisions of these AGB be invalid, the validity of the remaining provisions shall remain unaffected.
